1. Acceptance of Terms
By accessing or using any services provided by Viridian Tech ("Company," "we," "us," or "our"), including our website at viridiantech.cloud and all related hosting services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
We reserve the right to update or modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
Viridian Tech provides cloud infrastructure and game server hosting services, including but not limited to virtual private servers (VPS), managed web hosting, and dedicated game server hosting. Services are provided on a subscription basis as described on our pricing page.
We strive to maintain service availability but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible.
3. Account Terms
- You must be at least 18 years of age or have the legal capacity to enter into a binding agreement to use our services.
- You are responsible for maintaining the security of your account credentials. Viridian Tech is not liable for any loss or damage arising from unauthorized access to your account.
- You must provide accurate and complete information when creating an account and keep your contact information up to date.
- Each account is for a single user or entity. Sharing account credentials with third parties is prohibited.
4. Payment Terms
- All payments are processed securely through Stripe. By subscribing to a plan, you authorize recurring charges at the stated interval.
- Prices are listed in USD and are subject to change with 30 days' notice. Existing subscriptions will honor their current pricing until the next renewal cycle after the effective date of any price change.
- Refunds are available within 48 hours of initial purchase. To request a refund, contact us at admin@viridiantech.cloud.
- Failure to maintain a valid payment method may result in service suspension. We will provide at least 7 days' notice before suspending services due to non-payment.
5. Acceptable Use Policy
You agree not to use our services for any unlawful or prohibited activities. The following uses are strictly prohibited:
- Distribution of malware, viruses, or other harmful software.
- Hosting content that infringes on intellectual property rights or violates applicable laws.
- Engaging in DDoS attacks, port scanning, or other network abuse targeting third parties.
- Cryptocurrency mining or other resource-intensive activities not explicitly permitted by your plan.
- Hosting phishing websites, spam operations, or fraudulent services.
- Any activity that degrades the performance or availability of shared infrastructure for other customers.
Violation of this policy may result in immediate suspension or termination of your account without refund.
6. Service Level Agreement
Viridian Tech commits to a 99.9% uptime guarantee for all paid hosting plans, measured on a monthly basis. This excludes scheduled maintenance, force majeure events, and issues caused by customer actions.
If uptime falls below the guaranteed level in any calendar month, affected customers may request a service credit. Credits are calculated as a prorated percentage of the monthly fee and must be requested within 30 days of the incident.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Viridian Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services.
Our total aggregate liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
We are not responsible for data loss. You are solely responsible for maintaining backups of your data and content hosted on our infrastructure.
8. Termination
You may cancel your subscription at any time through your dashboard or by contacting us. Cancellation takes effect at the end of the current billing period, and no further charges will be incurred.
We reserve the right to suspend or terminate your account at any time for violations of these Terms, non-payment, or any other reason at our sole discretion. In the event of termination for cause, no refund will be provided.
Upon termination, your data will be retained for 30 days to allow retrieval, after which it will be permanently deleted.
9. Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via email or through a notice on our website at least 30 days before they take effect. Your continued use of our services after the revised Terms become effective constitutes your acceptance of the changes.
